Terms of service

These terms are an agreement between you and the individual operating konata (“we”, “the operator”, contact: [CONTACT EMAIL]). By creating an account or using the service you accept them. If you do not accept them, do not use the service.

The service

konata is a prepaid gateway that gives you API access to large language models served by third-party providers. You top up a balance, and usage is deducted from it per token at the published rates. konata is an independent service: it is not affiliated with, endorsed by, or operated by Anthropic, OpenAI, or any other model provider.

Some models are made available through partners: third parties operating upstream provider accounts that the gateway routes through. This changes nothing for you: billing, support, and the commitments in our privacy policy apply the same way to partner-served traffic.

Requests and responses are passed through unmodified: neither we nor our partners ever inject or alter content, instructions, or tool calls. The only transformation the gateway performs is translating between API dialects when your client and the model speak different wire formats.

Eligibility and accounts

You must be at least 18 years old, or the age of majority where you live, whichever is higher.

Your account and API tokens are yours to protect. Anything done with your tokens counts as done by you and is billed to your balance. If you believe a token leaked, revoke it in the dashboard immediately.

Balance and payments

  • Top-ups are processed by a third-party payment processor. The amount credited is the USD value confirmed by the processor, minus its fees where applicable.
  • Your balance is a prepayment for future usage of the service. It is not money, does not accrue interest, cannot be transferred to another account, and cannot be withdrawn or redeemed for cash.
  • Top-ups are non-refundable except where a refund is required by applicable law, or where we credited you in error.
  • Promo codes are credited at our discretion and carry no cash value.

Billing

  • Usage is metered per token (input, output, and cache traffic) at the rates published on the site at the time of the request.
  • While a request is in flight, an estimated worst-case amount may be temporarily reserved from your balance; the reservation is settled to the actual cost when the response completes.
  • A response you interrupt or that terminates early is still billed for the tokens actually processed.
  • Rates may change at any time; changes apply only to future requests, never retroactively.

Acceptable use

You agree to:

  • use the service only for lawful purposes;
  • comply with the usage policies of the upstream model providers whose models you access through the service;
  • not attempt to probe, overload, disrupt, or circumvent the service’s security, metering, or rate limits;
  • not resell access to the service or share your account with third parties;
  • not use the service to violate anyone’s rights or to generate content that is illegal where you are located or under the EU legislation.

You are solely responsible for the prompts you send and for how you use model outputs.

Suspension and termination

We may suspend or restrict your account, temporarily or permanently, if automated safety systems flag your traffic, if we suspect fraud, abuse, or a violation of these terms, or if an upstream provider requires it. Where practical we will tell you why.

You may stop using the service and delete your account at any time from the profile page. Deleting your account forfeits any remaining balance - if you have a meaningful balance left, contact us before deleting.

If we terminate your account without cause, we will make a reasonable effort to return your unused balance.

Availability and changes to the service

The service is provided “as is” and “as available”, with no uptime guarantee. The set of available models depends on third-party providers and may change, degrade, or disappear at any time without notice. We may modify or discontinue any part of the service.

Content and outputs

As between you and us, you retain whatever rights you hold in your prompts and in the model outputs. Model outputs are generated by third-party systems and may be inaccurate, incomplete, or unsuitable for your purpose; do not rely on them without your own verification. Your use of outputs may additionally be subject to the upstream provider’s terms.

Disclaimer and limitation of liability

To the maximum extent permitted by law: the service is provided without warranties of any kind, express or implied; and the operator’s total liability for any claims arising out of or relating to the service is limited to the amount you paid for the service in the three months preceding the event giving rise to the claim. The operator is not liable for indirect, incidental, or consequential damages, or for loss of profits, data, or business.

Nothing in these terms excludes liability that cannot be excluded under applicable law.

Changes to these terms

We may update these terms; the current version is always published on this page with its date. Material changes will be announced on the site, and your continued use of the service after a change takes effect constitutes acceptance. If you do not accept a change, stop using the service and delete your account.

Final provisions

These terms are governed by the laws of the European Union, and disputes are subject to the courts of the European Union, unless mandatory consumer-protection law where you live provides otherwise. If any provision of these terms is found unenforceable, the rest remain in effect.

These terms are published in English and Russian; in case of any discrepancy, the English version prevails.
